GlobaGift Gift Card Terms

These terms apply when you purchase, receive, access or use a digital gift card issued through the GlobaGift platform.

Please read these terms carefully before buying or using a Gift Card. By purchasing, receiving, accessing or using a Gift Card, you agree to these terms.

1. Who we are

The Gift Card is issued by Globapay Holdings Limited, trading as GlobaGift, a company incorporated in Ireland with company number 781644 and registered office at 20 Harcourt Street, Dublin, D02 H364, Ireland.

In these terms, "GlobaGift", "we", "us" and "our" mean Globapay Holdings Limited.

The merchant named on the Gift Card is the business with which the Gift Card may be redeemed. In these terms, we call that business the "Merchant".

2. What the Gift Card is

The Gift Card is a merchant-branded digital gift card issued by GlobaGift for use with the named Merchant only.

It can be redeemed only with the named Merchant, only for that Merchant's eligible goods and services, and only through redemption channels approved for that Merchant.

The Gift Card is not a bank account, payment account, credit product, debit card, open-loop payment card or general-purpose payment instrument.

The Gift Card cannot be redeemed for cash, withdrawn as cash, transferred to a bank account, used to buy foreign currency, or converted into any other general-purpose payment instrument, except where applicable law requires otherwise.

3. Purchasers, recipients and cardholders

A person who buys a Gift Card is the "Purchaser".

A person who receives, accesses or uses a Gift Card is the "Cardholder".

The Purchaser and Cardholder may be the same person or different people. These terms apply to both.

4. Eligibility

You must be at least 18 years old and able to enter into a legally binding contract to purchase a Gift Card. Where a Cardholder is under 18, the Gift Card should be purchased and managed by a parent or guardian.

5. Buying a Gift Card

Gift Cards may be purchased through an approved GlobaGift checkout, embedded webshop, hosted checkout page, distribution partner or other approved sales channel.

At checkout, you will be shown the key purchase details, including the Merchant, Gift Card value, currency, expiry information, any applicable service fee, any applicable currency conversion rate or margin, and any other information required by applicable law.

Your payment may appear on your card or bank statement under a GlobaGift billing descriptor or a GlobaGift descriptor identifying the Merchant.

Once your payment is authorised and any required checks are completed, the Gift Card will be issued digitally and sent or made available using the delivery method selected at checkout.

6. Order screening, fraud checks and refusal

Each Gift Card purchase is subject to payment authorisation, fraud screening, sanctions screening, anti-money-laundering checks and other security or programme-integrity checks.

We may refuse, delay, cancel, suspend or reverse an order or Gift Card where we reasonably believe that the order, payment, purchaser, recipient, Gift Card or redemption is subject to additional verification, fraud risk, misuse, sanctions risk, payment failure, chargeback risk, technical error, breach of these terms, breach of law, payment-provider requirement or any other legal, regulatory, security or programme-integrity concern.

We are not required to provide detailed reasons where doing so may compromise fraud prevention, security, legal compliance, payment-provider requirements or programme integrity.

7. Delivery of digital Gift Cards

Gift Cards are delivered digitally to the email address, mobile number, link, wallet, account or other delivery method selected or entered at checkout.

Delivery is usually shortly after purchase, but may be delayed where payment authorisation, fraud checks, sanctions screening, technical processing, delivery-provider delays or other operational checks are required.

You are responsible for ensuring that all recipient details, delivery details, personal messages and order information are accurate before submitting the order. In some cases, we may not be able to correct errors after the order has been placed.

If you believe you entered incorrect delivery details, contact us as soon as possible at [email protected]. Where the Gift Card has not been accessed or redeemed, we may be able to resend, redirect, suspend or replace it.

8. Gift Card value

The redeemable value of the Gift Card is the face value shown on the Gift Card or in the purchase confirmation.

Any service fee, processing fee, distribution fee, delivery fee, currency conversion margin or other purchase-time charge shown at checkout is separate from the redeemable Gift Card value, unless expressly stated otherwise.

9. Fees after purchase

We do not charge any dormancy, inactivity, maintenance, service or other fee after the Gift Card has been purchased. The only charges that may apply are the purchase-time charges shown at checkout.

10. Promotional and bonus value

Where a Gift Card includes promotional, bonus or discounted value (for example, extra value added as part of an offer), the promotional element may be subject to additional conditions shown at the time of the offer, including a shorter validity period or exclusion from any refund.

Unless required by applicable law, any refund will be calculated by reference to the amount you actually paid.

11. Currency

The Gift Card will be issued in the currency shown at checkout.

If you choose to view or pay in another currency, a currency conversion rate or margin may apply. Any such amount will be shown at checkout where required by applicable law.

The Merchant will redeem the Gift Card based on the Gift Card currency and value recorded by the GlobaGift system.

12. How to redeem a Gift Card

To redeem a Gift Card, present the QR code, code, link or other redemption credential to the Merchant through an approved redemption channel.

The Gift Card must be electronically validated by the GlobaGift system at the time of redemption. The Merchant is not required to accept a Gift Card that cannot be validated.

A Gift Card may be redeemed only for the Merchant's eligible goods and services. It may not be redeemed with any other business, affiliate, franchisee, reseller, concessionaire, marketplace seller or third party unless that location or channel has been expressly approved for the relevant Gift Card programme.

13. Partial redemption and remaining balances

Where partial redemption is supported, you may use part of the Gift Card value and keep the remaining balance for later use before expiry.

No cash or change will be given for any unused balance, except where applicable law requires otherwise. For Gift Cards sold to consumers in Ireland, see the section "Additional terms for Gift Cards sold in Ireland" below.

Where partial redemption is not supported by the Merchant or redemption channel, this will be made clear where reasonably possible before redemption.

14. Expiry

The Gift Card expires on the expiry date shown at checkout, in the purchase confirmation, on the Gift Card itself or on the Gift Card access page.

Unless a different period is shown or required by applicable law, the standard Gift Card validity period is 12 months from the date of issue.

For Gift Cards sold to consumers in Ireland, a minimum validity period of 5 years applies. See the section "Additional terms for Gift Cards sold in Ireland" below.

Where the law of the relevant sale market, purchaser location or redemption market requires a longer validity period, that longer period will apply.

After expiry, the Gift Card may no longer be used, and any remaining balance will be dealt with in accordance with applicable law.

15. No cash-out

The Gift Card cannot be exchanged for cash.

No cash withdrawal, cash refund, bank transfer, card refund or cash equivalent is available for any Gift Card balance, except where applicable law requires otherwise.

16. Risk, access details and unauthorised use

You should treat the Gift Card link, QR code, code and access details as you would cash.

Anyone with access to the Gift Card details may be able to use the Gift Card.

Risk of unauthorised access or use passes to the Purchaser or recipient when the Gift Card is delivered to the delivery details provided at checkout, except where the loss is caused by our fraud, negligence, technical error or breach of law.

We are not responsible for unauthorised use of a Gift Card before we are notified and have had a reasonable opportunity to suspend or protect it.

Where we can verify that a Gift Card has not been redeemed, we may, at our discretion, suspend, reissue or replace it.

To ask us to suspend, reissue or replace a Gift Card, contact us at [email protected] with the order reference, the Purchaser's email address and the Merchant name. We may ask for additional information to verify the request.

17. Transfer and resale

You may give the Gift Card to another person as a gift. The recipient will hold and use the Gift Card subject to these terms.

Gift Cards may not be resold, traded, auctioned or otherwise used for any commercial purpose without our prior written consent. We may suspend or cancel a Gift Card that we reasonably believe has been resold or traded in breach of this section.

18. Refunds and cancellations

Refunds and cancellations are governed by our Refund & Cancellation Policy.

Unless required by applicable law or allowed under that policy, Gift Cards are not refundable after purchase.

If you are a consumer in the European Union, you may have a statutory right to cancel your purchase within 14 days of the date the Gift Card is issued, provided the Gift Card has not been accessed or redeemed. Details of how to exercise any cancellation right are set out in our Refund & Cancellation Policy.

19. Merchant goods and services

The named Merchant is responsible for supplying the goods and services purchased using the Gift Card.

GlobaGift is responsible for issuing and administering the Gift Card, maintaining the Gift Card record, supporting access to the Gift Card and validating redemptions through the GlobaGift platform.

GlobaGift is not responsible for the quality, safety, availability, description, delivery, cancellation, booking, fulfilment or performance of the Merchant's goods or services.

Questions, complaints or claims about the Merchant's goods or services should be raised with the Merchant.

Nothing in these terms affects any statutory consumer rights you may have against the Merchant in respect of goods or services supplied by the Merchant.

20. Refunds for goods or services bought with a Gift Card

Returns, refunds and complaints relating to goods or services purchased with a Gift Card, including how any approved refund is returned to a Gift Card balance, are governed by our Refund & Cancellation Policy and the Merchant's own policies, together with applicable consumer protection law.

21. Merchant closure or inability to honour Gift Cards

Where the Merchant closes, stops participating in the GlobaGift programme or is unable or unwilling to honour valid Gift Cards, the remedies available to you are set out in our Refund & Cancellation Policy. Contact us at [email protected].

22. Fraud, misuse and suspension

We may refuse, suspend, cancel or reverse a Gift Card or redemption where we reasonably believe that there has been fraud, misuse, error, unauthorised access, breach of these terms, breach of law, sanctions risk, anti-money-laundering concern, technical issue, chargeback, payment failure or other programme-integrity risk.

We may also refuse or suspend a Gift Card where required by law, by a payment provider, by a banking partner, by a card scheme, by a regulator, by a court or by another competent authority.

23. Our liability to you

Nothing in these terms excludes or limits our liability for fraud, for death or personal injury caused by our negligence, or for any other liability that cannot be excluded or limited under applicable law, and nothing in these terms limits your statutory consumer rights.

Subject to the paragraph above, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity or loss of goodwill arising in connection with a Gift Card.

Subject to the paragraph above, our total liability to you in connection with a Gift Card is limited to the face value of that Gift Card plus any purchase-time charges you paid to us for it.

24. Changes to these terms

We may update these terms from time to time.

The terms in force when you buy the Gift Card will generally apply to that Gift Card, except where a change is required by law, required by a regulator or payment partner, necessary for security or fraud prevention, or more favourable to you.

The latest version of these terms will be available through the GlobaGift checkout, Gift Card access page or our website.

25. Privacy

We process personal data in accordance with our Privacy Notice.

The Merchant may also process your personal data as an independent controller when you redeem a Gift Card or interact with the Merchant. Please read the Merchant's own privacy notice for more information about how the Merchant uses personal data.

26. Complaints and support

If your question or complaint relates to the Merchant's goods, services, premises, booking, order, delivery, refund or customer service, you should also contact the Merchant directly.

If you are not satisfied with our response, you may be able to refer your complaint to a local consumer protection body or authority in your country.

27. General

If any part of these terms is found to be invalid or unenforceable, the remaining terms will continue to apply.

If we do not enforce any part of these terms, this does not mean we have waived our right to do so later.

These terms, together with the Refund & Cancellation Policy and the information shown at checkout, form the agreement between you and us in relation to the Gift Card.

Where these terms are made available in more than one language, the English version prevails to the extent permitted by applicable law.

28. Governing law

These terms are governed by the laws of Ireland, except where the mandatory consumer protection laws of another country apply.

Nothing in these terms limits any mandatory rights you have under the consumer protection laws of the country where you live, where the Gift Card is sold, or where the Gift Card is redeemed.

29. Additional terms for Gift Cards sold in Ireland

This section applies where a Gift Card is sold to a consumer in Ireland. It reflects the Consumer Protection (Gift Vouchers) Act 2019 and other Irish consumer law. If there is any conflict between this section and the rest of these terms, this section prevails for those Gift Cards.

Validity period. The Gift Card will be valid for at least 5 years from the date it is issued. Any longer validity period shown at checkout will apply.

No single-transaction requirement. You are not required to spend the full Gift Card value in one transaction, and the number of Gift Cards you may use in a single transaction is not limited, subject to the redemption channel supporting this.

Remaining balance. If you redeem a Gift Card and more than €1 of the balance remains and cannot be spent in that transaction, we will reimburse the remaining balance to you by cash, electronic transfer or a replacement Gift Card, in accordance with the Act.

Right to cancel. If you buy a Gift Card online or at a distance as a consumer, you may cancel the purchase within 14 days of the date the Gift Card is issued, without giving a reason, provided the Gift Card has not been accessed or redeemed. To cancel, contact us at [email protected]. We will refund the amount you paid, including any purchase-time charges, to the original payment method without undue delay.
